Client v. Martello
Our Client was involved in a motor vehicle accident where her vehicle was struck in the rear by the offending vehicle resulting in her sustaining a traumatic brain injury. At the time, our Client was attending a Master’s program and planning on attending law school. However, she was unable to attend law school because of the difficulties she faced on a daily basis as a result of her brain injury. We successfully argued that the findings of her MRI with Diffusion Tensor Imagining, which identified structural injury to her microscopic brain tissue, was consistent with the difficulties she experienced but also that they were likely to be permanent.
